Put the advertisement and the official page side by side
Print the sponsored post and the official program material and mark every claim in the advertisement that the official source does not support. Timelines, tax outcomes, family coverage and refundability are the four claims most often added by intermediaries. What remains after that exercise is the actual offer. If an intermediary declines to identify the official source for a claim, treat the claim as unsupported rather than as inside information.
Keep the gift distinct from an investment
An investment is capital placed in an enterprise where it remains at risk and may be returned with a profit or lost. A gift to the U.S. government is neither returned nor invested, and no business, job creation or ownership follows from it. Anyone describing the payment as an investment, or comparing it to EB-5 as though the money behaves the same way, is describing something other than the official framework.
Establish who receives the money and under what instrument
Before anything is transferred, identify the payee named in the official process, the account it goes to, the document that records the payment, and the circumstances in which any part is returnable. Ask the same questions about any consultant's charge, which is a separate contract with a separate party. A payment made to an intermediary's account on a promise is not the same transaction as one made through the official process.
Re-verify the terms on the day you act
The program's requirements, amounts and family provisions have been announced and revised through official channels, so a description accurate one month may be incomplete the next. Check the official program page and any implementing announcement on the day a decision is made, note the date checked, and record what the page actually said. Advice that is not dated is not usable for something moving this quickly.
Follow the official payment sequence and individual amounts
Official instructions let a corporate sponsor apply a prior US$2 million gift toward sponsoring a different employee, subject to new vetting and the transfer requirements in force at the time. Corporate terms include published 1% annual maintenance and 5% transfer with new background review and actual programme conditions; a recruitment substitution is not automatically a completed programme transfer. The framework operates in connection with existing employment-based immigrant classifications, so the applicable classification requirements, admissibility and visa availability continue to apply. Eligibility for lawful permanent residence, admissibility, and visa availability remain required regardless of willingness to pay, so the financial commitment should never be described as an automatic approval or a fixed processing date. The official process conducts its own vetting; a private report, even one showing no findings, does not decide immigration admissibility or guarantee approval. Obtain the official instructions, the identity of each applicant or included relative, and a written breakdown that distinguishes government charges from private services. Sequence eligibility analysis before payment execution: confirm the relevant EB-1 or EB-2 basis, admissibility and visa availability, then follow official instructions if the case reaches that stage.
