That the required capital was invested and sustained in the new commercial enterprise as required, and that the ten full-time jobs for qualifying workers were created, or in some circumstances will be created within a reasonable period. The petition to remove conditions carries that burden.
The case is not finished when the family lands
Hypothetical example: the family arrive, settle children in school and treat the matter as closed. Two years later a petition must be filed within a defined window, supported by evidence about a project the investor does not control. That is why the sponsor's reporting obligations matter so much at the subscription stage: without financial statements, payroll records and job-creation evidence from the project, the investor has nothing to file.
Ask what is provided, how often, and what happens if the sponsor stops responding. The underlying requirements have not changed in the meantime — qualifying capital at risk, lawful source and path, the investor engaged in management or policy formulation rather than wholly passive, and job creation measured as the applicable methodology defines it. Verify current capital amounts against official material rather than an older summary.
