Start with the L-1B eligibility and application overview
Name the company-specific knowledge as a list of items
Write down what he knows that belongs to this company: the control sequence written for its membrane skids, the commissioning order developed after a failure at a particular plant, the tolerances the company uses that differ from the manufacturer's defaults, the fault library built from its own installations. Each of those is an item with a document behind it. General competence in treatment plant start-up, instrumentation or process control belongs on a separate list, because that is knowledge the industry shares.
State how many colleagues hold the same knowledge
A claim that one person is the only one who can do something is easily tested and often wrong. Say how many employees have commissioned these skids, what distinguishes this specialist from them, and why those others cannot be sent. If the honest answer is that three people could do it but only one is available, say so and explain the operational reason. An accurate limited claim is more durable than an absolute one that a single question can dismantle.
Show how the knowledge was acquired inside the company
The knowledge should have been gained through employment with the organisation. Assemble the project history showing which installations he commissioned, the internal procedures he wrote or revised, the training he delivered to junior staff, and any internal certification the company maintains. Where he brought expertise from a previous employer, be clear about the boundary, because that portion is his professional background rather than the company's specialized knowledge.
Check the assignment is not the supply of labour
If commissioning takes place at a municipal client's site, the arrangement must not amount to placing a worker under the client's direction. The petitioner assigns the tasks, sets priorities, supervises performance and pays the salary, and the client receives a commissioned plant under a contract. Review the services agreement before filing and correct anything that reads like staffing, because the wording of that contract is evidence.
Describe the relevant special or advanced knowledge
Work at a third-party location is permitted only if the transferee is not principally controlled and supervised by the unaffiliated employer and the work is not essentially labour for hire. USCIS evaluates specialized knowledge under the totality of the circumstances; proprietary or unique knowledge can support a case but is not required. The legal basis concerns special knowledge of organizational interests and international application, or advanced knowledge of organizational processes and procedures; urgency and trust alone do not establish it. Describe the employee’s actual command of relevant company methods, exceptions and applications; familiarity with a general standard or a labour shortage does not alone establish the classification. L-1B focuses on specialized knowledge of the petitioning organization’s products, services, research, equipment, techniques, management, or other interests and their application in international markets.
