Possibly. Headcount is not the test. The definition covers managing an essential function at a senior level with authority over it, as well as managing people, but the evidence has to show decision-making authority rather than skilled personal work.
Authority over the function, not the size of the team
Hypothetical example: the director sets the plant's food-safety standards, approves supplier specifications, signs off on corrective actions and can halt a production line. Two technicians execute the testing programme he designs. That is a defensible function-manager description, and it should be written in exactly those terms: what he decides, what he approves, what he can stop and who reports the results to him.
Contrast that with a description built from verbs like tests, records, inspects and reports, which describes a senior specialist. Where the specialist reading is the accurate one, L-1B may be the honest category instead, assessed against specialized knowledge of the company's own processes rather than against managerial duties. The other requirements still have to hold: a qualifying corporate relationship with both entities operating, one continuous year of qualifying employment abroad in the last three, and duties in the United States that remain primarily managerial once the plant is running.
