Start with the L-1B eligibility and application overview
Specialized knowledge is about the company's own methods, not the profession
L-1B requires special knowledge of the petitioning organization's product, service, research, equipment, techniques or management, or an advanced level of knowledge of its processes and procedures. Many nutritionists can formulate a ration. What only a few people know is this company's proprietary model, its ingredient-substitution rules, its quality tolerances and the way it integrates with the mill's batching controls. The petition must describe that knowledge concretely and show that Priya holds it to a degree beyond her co-workers. A statement that she is very experienced is not the same as showing what she knows that others in the industry do not.
Document the knowledge while it is still being used in Canada
The most persuasive evidence is created before the transfer: the model's documentation with Priya named as author or maintainer, internal training materials she wrote, records of the versions she released, emails showing staff coming to her for rulings, and a letter from the plant manager explaining how long it would take to train a replacement. Once she is in the United States, that trail is harder to assemble. The one continuous year of employment abroad within the three years before filing must also be proven from payroll, and nine years is comfortably more than needed provided it is continuous.
The U.S. mill must be a qualifying organization and must be operating
The purchased mill becomes a subsidiary if the Canadian company bought it, or an affiliate if the same owners bought it in matching proportions. Both companies must remain active: the Canadian manufacturer keeps producing feed after Priya leaves, and the U.S. mill must actually run, with its own payroll and customers. Priya's U.S. assignment must be to the petitioner group, installing the group's system in the group's mill. If instead she were placed at a customer's feedlot to formulate rations for them, the petition would have to show that the company, not the customer, controlled her work and that she was applying the specialized knowledge, not simply supplying labour.
Duration, family and what comes after
L-1B admission can total five years, and an initial period of up to three years is available when the U.S. entity has been operating for more than a year; a mill acquired as a going concern generally is not a new office. Priya's spouse would be admitted in L-2 status with employment authorization incident to status, and unmarried children under 21 may study but not work. If the company later wants her to manage the U.S. formulation department, a change to L-1A is possible only if the new duties are primarily managerial, and the total time in L status still counts toward the limits. Plan the two-year installation with the five-year ceiling in view.
