THE SHORT ANSWER

Hypothetical example: Sandra is selling her share of a Lethbridge County potato-storage and packing business and has been approached about two things: an EB-5 regional-center project in a rural targeted employment area, and a Gold Card application. She wants to know what each amount buys, what happens to the money, what her husband gets, and which one leads to permanent residence on what timeline. The two are not versions of each other. EB-5 is an at-risk investment with conditional residence and job requirements; the Gold Card is a gift to the U.S. government under an official program whose terms must be read directly.

What the money does in each route

In a regional-center EB-5 case, Sandra's capital, US$800,000 for a rural targeted employment area project at the time of writing, is invested in a new commercial enterprise, placed at risk, and must be sustained through the conditional period; she may or may not get it back, depending on the project, and she is entitled to no guaranteed return. The jobs are counted under the regional center's economic model, including indirect employment, and she must still be engaged in policy formulation, typically as a limited partner with statutory rights. The Gold Card, under Executive Order 14351 and the official program page, involves an unrestricted gift to the U.S. government plus a processing fee; nothing is invested, nothing is returned, and there is no project. The amounts for both should be re-verified on the official sources before any money moves.

What the household receives, and when

EB-5 leads to conditional permanent residence for Sandra, her husband and unmarried children under 21 once the I-526E is approved and a visa is available, with Form I-829 filed in the 90 days before the second anniversary to remove conditions after two years; rural projects carry a statutory set-aside and priority processing under the 2022 reforms, which may shorten the wait but should not be promised as a fixed number. The Gold Card's underlying immigrant category, the treatment of a spouse and children, and the sequence from application through vetting to issuance are described on the official program site, and Sandra should read that description herself and record the date, because the framework is new and may change. Neither route lets her move to the United States on the strength of a wire transfer; each requires the status document first.

Questions to settle before either cheque is written

Sandra should first trace her share of the sale proceeds: the partnership or shareholder agreement, the buyout agreement, the closing statement, and the bank records to her personal account, because both EB-5 and the Gold Card's vetting expect lawful source and path. She should then ask whether she wants her money working in a business she cannot control, with the possibility of loss, or given outright with no return; whether her husband will be included on the same terms in each; and what she will do if the EB-5 project fails to create the modelled jobs or the Gold Card terms change after payment.
