Compare job evidence with gift-payment evidence

THE SHORT ANSWER

Direct EB-5 and individual Gold Card planning call for different records. EB-5 requires qualifying at-risk investment and job creation. Gold Card uses the stated gift framework within applicable immigrant-category requirements. Accurate financial documentation matters to both, but it does not make their legal tests interchangeable. The financial decision is whether to place capital at risk in a job-creating enterprise or make the distinct official payment required by the Gold Card process; calling both a payment hides their different evidence and consequences. Hypothetical example: A Canadian builder of harps has proceeds from selling a workshop and wants US residence with her spouse. She must decide whether she can support EB-5's capital and job records or whether Gold Card eligibility and a gift payment fit the family's facts.

For EB-5, examine qualifying positions

A direct EB-5 plan must document the applicable $1,050,000 investment, or $800,000 for a qualifying targeted employment area or infrastructure project, lawful source and path of funds, investor participation in management or policy formulation, and at least ten qualifying full-time jobs. EB-5 leads first to two-year conditional permanent residence, with Form I-829 filed in the 90 days before the second anniversary; an eligible spouse and unmarried children under 21 may be derivatives. For direct EB-5, decide how ten qualifying full-time jobs will be created and documented, then trace the lawful source and path of the capital. The capital remains at risk, and residence begins conditionally if the immigration process is completed.

For Gold Card, separate fees from gifts

The current individual framework states a US$1 million gift to the U.S. government after vetting and a US$15,000 non-refundable processing fee; each eligible joining family member adds the stated amounts. Gold Card is not a conventional statutory visa category, and its gift is not an EB-5 investment. Re-verify the official terms and payment instructions before any money moves. For Gold Card, distinguish the official processing fee from the payment made by the applicant to the U.S. government. It is not a conventional visa or an equity purchase, and current official materials should be checked before any irreversible transfer.

Keep immigration milestones distinct

An EB-5 investor petition is not itself permanent residence, and paying a Gold Card amount is not work authorization. Assess category eligibility, admissibility and visa availability, then identify the actual remaining steps for each applicant. Neither option guarantees a decision date or citizenship. Decide how long the household can wait and what records must be kept afterward. EB-5 requires later condition removal evidence; Gold Card payment does not itself establish admission or work authorization, and both routes retain eligibility and availability questions.
